Article 1. Applicability
On all offers, orders and agreements of Gopher Publishers (Gopher) these General Terms of Sale (Terms) are, excluding other general terms, applicable. Accepting an offer and/or the placing of an order means that you accept the Terms. Any deviation from these Terms is only valid through written announcement and/or approval of Gopher, in which case all other terms remain applicable. All rights and liabilities stated in these Terms, or other agreements in favour of Gopher, will apply equally to intermediaries and third parties. The Terms respect the rights of client under other statutes and common law.
Article 2. Offers/Agreements
All offers by Gopher are without obligation and Gopher retains the right to alter prices. An agreement can only be reached after Gopher accepts your order. Gopher is entitled to refuse orders and to impose certain conditions on the order. Gopher will give notice if an order is not accepted, within ten (10) days after the order has been received.
Article 3a. Prices and payment (of goods available in the Gopher shop)
Prices are in Dutch guilders, including VAT and excluding carriage.

1. by credit card
2. an invoice (Netherlands only, within 30 days of issue, maximum �60 or 200NLG)

Article 4. Delivery
The delivery time, as stated by Gopher, is only approximate. Exceeding the delivery time does not give you any right for compensation, cancellation or the order or annulment of the agreement, unless the delivery time exceeds by an unreasonable amount. In that case, you are entitled to cancel the order and annul the agreement. The delivery of the products is defined as the place and time when the products are ready for despatch.
Article 5. Intellectual and industrial ownership rights
You are obliged to accept unconditionally all intellectual and industrial ownership rights which rest on the services and products offered by Gopher. Gopher does not guarantee that the products delivered to you do not violate any (unwritten) third party intellectual and/or industrial ownership rights.
Article 6. Liability
You are obliged to check that your delivery complies with the agreement. In the case of defective or damaged goods, please notify Gopher in writing as soon as possible and no more than (fifteen) 15 days after delivery. Gopher may replace defective goods or reimburse their value.
You are entitled to return any product to Gopher with fifteen (15) days of delivery. Any products returned will be accepted only if the packaging is intact and the plastic seal has not been broken. The customer is responsible for return postage.
Article 7. Personal data
Gopher will store your data in a file. This will be used to execute your order and will therefore be made available to third parties. Your personal data, unless you have indicated otherwise, will be store in our central file for purposes of customer services.
Article 8. Circumstances beyond our control
Notwithstanding other rights, Gopher retains the right to cancel orders due to circumstances beyond our control. Gopher will announce such decisions in writing or by email.
Article 9. Delivery of Order
Gopher will despatch goods to the address provided by you for delivery and may make use of the services of a third party to deliver your order.
Article 10. Appropriate law and competent judge
Dutch law applies on all rights, obligations, offers, orders and agreements applicable to these terms.
